What couples say

From the firm's website.

“Patrick was extremely helpful and professional throughout our mediation process. He explained every detail thoroughly and guided us through the agreement. He is a kind man who truly tries to be as fair as possible to both parties while educating them on the entire process. We saved a large sum of money on legal fees by choosing mediation with Patrick.”

W.M. · Client testimonial, from the firm's website

“Attorney Morris took a great deal of time explaining the mediation process, answering all of our questions, drawing up the necessary paperwork ... and made himself readily available to us throughout the process.”

L.M.F. · Client testimonial, from the firm's website

“Patrick was a great resource for our uncontested divorce. He explained his role in the mediation process very clearly and described how the divorce process works in detail, all before requesting a fee. Once mediation started he was very helpful in explaining how the Court sees marriage and divorce.”

Step by step

How an uncontested divorce runs in Massachusetts

You agree

In mediation with Patrick, or already between yourselves. Every issue is covered: property, debts, the children, support, health insurance, taxes.

The papers

A separation agreement, a financial statement from each of you and a joint petition for divorce, prepared by Patrick and filed with the court.

The hearing

One short hearing, together, at the Probate and Family Court. The judge reviews the agreement with both of you.

The first meeting

What the first conversation looks like

You and your spouse come in together, or join by video. Patrick asks whether you are both here by choice, then explains what mediation is and what it is not.

He walks through what a divorce has to settle, the home, the children, support, retirement accounts, and answers every question. Nothing is decided yet.

You leave knowing the process, the flat fee and the next date, if you both want to go on.

Settled

What the separation agreement covers

Property and debts

The house, bank and retirement accounts, pensions, vehicles, credit cards and loans: who gets what, and when.

The parenting plan

Legal and physical custody, the weekly schedule, holidays and vacations, how you make school and medical decisions.

Support

Child support under the Massachusetts Child Support Guidelines, and alimony if any, with the amount and how long it lasts.

Health insurance and taxes

Who carries the children's health insurance, and the tax questions a divorce raises, settled in writing.

Questions

Common questions about an uncontested divorce in Massachusetts

Do we both have to go to court?

Yes, for one short hearing, together. The judge asks a few questions and reviews the agreement. Patrick prepares the two of you for it.

We agree on the main points, not all. Is it still uncontested?

It can be. Open points are what the mediation sessions are for. Only if one stays open does that single issue go before the judge.

What does an uncontested divorce cost?

With Patrick, a flat fee of $3,500 for both of you: three two-hour mediation sessions, all paperwork and the court filing fee. How you split it between you is your decision.

Is the first meeting free?

Yes. The first meeting is free and confidential, with both of you, at the office in Sandwich or by video. Ask everything you want to know. Nothing starts until you both decide to go on. Call (508) 833-2622.
